Thank you for coming in today, Mrs. Kessy. Can you tell me how long you and your husband have been separated?

To apply for divorce in Australia, you must show you've been separated for at least twelve months, and you must not have lived together again during that time.

If you can't locate him, the court may actually allow substituted service, but you'll need to file an affidavit explaining your attempts to find him.

Since your children are under eighteen, the court must be satisfied their care arrangements are proper, though a hearing usually isn't required.
