Can you walk me through what happened with the phone you bought from JB Hi-Fi, and what the store told you?
Under Australian Consumer Law, a phone that keeps freezing and won't charge can count as a major failure, not just a minor fault.
For a major failure, you choose the remedy — a refund, replacement or repair — not the retailer; they cannot force you to accept only a repair.
Since you bought it six weeks ago and it's frozen three times already, that pattern helps prove a major failure — keep the receipt and any videos.
If JB Hi-Fi still refuses, you can lodge a complaint with NSW Fair Trading, and if that doesn't resolve it, you may apply to NCAT.
You can apply to NCAT online; a hearing date will be set once your application is lodged and accepted — there's no fixed waiting period.
