Fair Work Infoline, Daniel speaking. How can I help you today?
Model answer and marking points
What an examiner checks here:
- Fair Work Infoline
- speaker's name: Daniel
- question: how can I help you today
Easy to miss: Keep the service name 'Fair Work Infoline' intact instead of translating or dropping it.
Model answer and marking points
Hello, sir. I run a café in Granville. This is the first time I'm hiring someone, for about twenty hours a week. Is it okay if we just discuss the pay between ourselves and decide on it?
What an examiner checks here:
- runs a café in Granville
- first time hiring an employee
- about 20 hours per week
- question: can the wage be agreed privately between them
Easy to miss: Keep 'about' (ഏകദേശം) with twenty hours, and keep the last sentence as a question rather than a statement.
Which award applies depends on what your café actually does, for example table service or takeaway. You cannot pay below the award minimum, even if the employee agrees.
Model answer and marking points
What an examiner checks here:
- applicable award depends on what the café actually does
- examples: table service or takeaway
- cannot pay below the award minimum
- even if the employee agrees
Easy to miss: Do not drop 'even if the employee agrees', which directly answers the caller's question.
Model answer and marking points
How would I know that, sir? We sell tea, coffee and sandwiches, and we do a bit of takeaway too. Also, do I have to pay super as well? Can I take it out of the wages?
What an examiner checks here:
- question: how would I know which award applies
- sells tea, coffee and sandwiches
- some takeaway as well
- question: do I have to pay super
- question: can super be deducted from wages
Easy to miss: There are two separate questions about super (must I pay it, and can I deduct it); keep both.
Use the award finder on our website. Yes, super is paid on top of wages, into the employee's fund. It is not deducted from their pay.
Model answer and marking points
What an examiner checks here:
- use the award finder on the website
- yes, super must be paid
- super is paid on top of wages
- paid into the employee's fund
- not deducted from their pay
Easy to miss: Keep the negation clear: super is NOT taken out of the employee's pay.
Model answer and marking points
I understand, sir. But the person who's coming to work says they're happy just to get cash in hand. If I pay that way, I don't need any paperwork, right?
What an examiner checks here:
- the worker wants to be paid cash in hand
- question: if paid in cash, is no paperwork needed
- tag question ('right?') seeking confirmation
Easy to miss: Keep the final sentence as a question seeking confirmation, not a statement that no paperwork is needed.
Cash is allowed, but you must still give a payslip within one working day of paying, and keep records. You report pay and super to the ATO through Single Touch Payroll.
Model answer and marking points
What an examiner checks here:
- cash payment is allowed
- must still give a payslip
- payslip within one working day of paying
- must keep records
- report pay and super to the ATO via Single Touch Payroll
Easy to miss: The time limit is one WORKING day after payment, not just 'one day' or 'one week'.
Model answer and marking points
Okay, sir. The person will only come on Saturdays and Sundays. So is the pay the same as on a normal weekday? And is it fine to just take them on as casual?
What an examiner checks here:
- worker comes only on Saturday and Sunday
- question: is the pay the same as on a normal day
- question: is it okay to employ them as casual
Easy to miss: Keep 'only' (മാത്രമേ) with Saturdays and Sundays, and render both questions.
Weekend work often attracts higher penalty rates under an award. Casual status depends on the arrangement, not the days worked. A firm, ongoing weekly commitment may mean part-time instead.
Model answer and marking points
What an examiner checks here:
- weekend work often attracts higher penalty rates
- under an award
- casual status depends on the arrangement
- casual status does not depend on the days worked
- a firm, ongoing weekly commitment may mean part-time instead
Easy to miss: Keep the hedges 'often' and 'may'; do not state that weekend rates always apply or that the job is definitely part-time.
Model answer and marking points
Okay, I'll look into that. What else do I need to do before they start work? I'm worried I might make a mistake.
What an examiner checks here:
- caller will look into it
- question: what else must be done before the employee starts
- caller is worried about making a mistake
Easy to miss: Keep 'before they start work' as the time condition of the question.
Give the employee a tax file number declaration, super choice form and the Fair Work Information Statement. If they don't choose a fund, ask the ATO about a stapled fund.
Model answer and marking points
What an examiner checks here:
- give a tax file number declaration
- give a super choice form
- give the Fair Work Information Statement
- if the employee doesn't choose a fund
- ask the ATO about a stapled fund
Easy to miss: All three documents must be listed; 'stapled fund' is easily dropped or mistranslated.
Model answer and marking points
Thank you very much, sir. I'll have them fill in the forms and give them to me, and if they don't mention any fund, I'll ask the ATO. If I have any doubts, I'll call again.
What an examiner checks here:
- thanks the officer
- employee will fill in the forms
- if no fund is mentioned, caller will ask the ATO
- will call again if there are doubts
Easy to miss: Keep the condition 'if they don't mention any fund' attached to asking the ATO.
